1. The Service

I Curated It lets you convert websites you choose into video content, and save, organize, search, and share social media links, images, and other content you submit, including links sent to us by WhatsApp. We may use automated tools, including artificial intelligence, to generate videos, summaries, tags, and other outputs. We may change, add, or remove features at any time.

2. Eligibility and accounts

You must be at least 13 years old, and old enough to form a binding contract where you live, to use the Service. If you are under 18, you may use the Service only with a parent or guardian's permission. You are responsible for keeping your login credentials secure, for all activity under your account, and for providing accurate information, including your email and phone number.

3. Your content

"Your Content" means links, images, files, text, and other material you submit, and outputs generated from it. You keep any ownership rights you have in Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, transform, and display Your Content solely to operate, provide, and improve the Service for you, including generating videos and AI summaries. If you share content through the Service, you allow the people you share it with to view it.

4. Third-party content and copyright

Websites, TikTok, Instagram, and other platforms are owned by third parties. You are responsible for making sure you have the right to submit, convert, save, or share any content you provide. Do not use the Service to convert or distribute content in a way that infringes anyone's copyright, trademark, privacy, or publicity rights, or that violates the terms of the platform the content came from. The Service is intended for personal curation and reference.

We respond to notices of alleged copyright infringement. Send notices to info@shadowfactory.io with: the work claimed to be infringed, the material and its location in the Service, your contact information, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and you are authorized to act, and your physical or electronic signature. We may remove material and terminate repeat infringers' accounts.

5. Acceptable use

You agree not to:

• •Submit unlawful, harmful, harassing, sexually exploitative, or hateful content
• •Infringe others' intellectual property or privacy rights
• •Upload malware or attempt to disrupt, probe, or gain unauthorized access to the Service
• •Scrape, resell, or commercially exploit the Service without our written permission
• •Use the Service to send spam or to impersonate anyone
• •Use the Service in violation of any law or third-party platform terms

6. AI-generated output

Videos, summaries, and tags are generated automatically and may be inaccurate, incomplete, or not reflect the original content. Review outputs before relying on or sharing them. We do not guarantee that outputs are unique or free of third-party rights.

7. Subscriptions, billing, and cancellation

Some features require a paid subscription. Prices and plan details are shown at checkout. Payments are processed by Stripe; by subscribing, you authorize recurring charges to your payment method at the start of each billing period until you cancel. Subscriptions renew automatically. You can cancel anytime in your account settings; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable. We may change prices with at least 30 days' notice before your next renewal.

8. Messaging

If you connect a phone number, our Text Messaging Policy below also applies to messages sent and received through WhatsApp or SMS.

9. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or others. After termination, we may delete Your Content in line with our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THIRD-PARTY LINKS WILL REMAIN AVAILABLE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $100.

12. Indemnification

You agree to defend and indemnify us against claims, damages, and costs arising from Your Content, your use of the Service, or your violation of these Terms or others' rights.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction. Nothing prevents either party from seeking relief in small claims court.

14. Changes to these Terms

We may update these Terms. If changes are material, we will notify you by email or in the Service before they take effect. Continued use after the effective date means you accept the updated Terms.

We do not store full payment card numbers; Stripe handles and stores them under its own security standards.

• •Process payments, subscriptions, and refunds

• •Maintain security, prevent fraud and abuse, and debug problems
• •Understand usage and improve the Service
• •Comply with legal obligations and enforce our Terms

We send marketing emails only where permitted, and you can unsubscribe anytime. We do not use your submitted content to train third-party AI models for their own purposes.

3. How we share information

We share information only as described here:

• •Service providers who process data on our behalf under contract, including cloud hosting and database providers, payment processing (Stripe), messaging providers (such as Twilio and WhatsApp), AI model providers that generate summaries and videos, and analytics and email providers
• •People you choose to share with, when you use sharing features
• •Legal and safety reasons: to comply with law or legal process, or to protect the rights, property, or safety of users, us, or others
• •Business transfers, such as a merger, acquisition, or sale of assets, subject to this policy

Mobile phone numbers and messaging opt-in data are never sold or shared with third parties or affiliates for their marketing purposes.

4. Cookies

We use cookies and similar technologies to keep you signed in, remember preferences, and understand how the Service is used. You can control cookies through your browser settings; disabling some cookies may break parts of the Service.

5. Data retention

We keep your information while your account is active and as needed to provide the Service. When you delete content or your account, we delete or de-identify related data within a reasonable period, typically 30 days, except where we must keep it for legal, tax, fraud-prevention, or dispute purposes. Backups may persist for a limited time.

6. Security

We use reasonable administrative, technical, and physical safeguards, including encryption in transit and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Your choices and rights

• •Access, update, or delete your account information in your settings
• •Delete saved links and content at any time
• •Disconnect your phone number or reply STOP to stop messages
• •Unsubscribe from marketing emails using the link in any email

Depending on where you live (for example, California or the European Economic Area), you may have rights to access, correct, delete, or port your personal information, to opt out of certain processing, and to not be discriminated against for exercising these rights. To make a request, email info@shadowfactory.io. We will verify your identity before responding. Where GDPR applies, our legal bases are performing our contract with you, our legitimate interests, your consent, and legal obligations, and you may complain to your local data protection authority.

8. Children

The Service is not directed to children under 13, and we do not knowingly collect their personal information. If you believe a child under 13 has given us information, contact us and we will delete it.

9. International transfers

We are based in the United States and process information there and wherever our service providers operate. Where required, we use appropriate safeguards for international transfers.

10. Third-party sites

Links you save lead to third-party sites and platforms with their own privacy practices. We are not responsible for them.

11. Changes

We may update this policy. We will post the new version with a new effective date and notify you of material changes by email or in the Service.

1. Program description

I Curated It Messages let you save content to your library by sending us links, and receive related service messages: confirmation that a link was saved, AI summaries of saved content, account verification codes, and service notices. We do not send promotional messages through this program.

2. Consent

You opt in by connecting and verifying your phone number in your account settings and sending a message to our number. By doing so, you agree to receive Messages from I Curated It at that number. Consent is not a condition of any purchase. Only connect a number you own or are authorized to use.

3. Message frequency

Message frequency varies and depends on how often you send us content, usually one or two replies per link you send.

4. Costs

Message and data rates may apply, depending on your mobile carrier and plan. WhatsApp messages use your data connection.

5. Opting out

Reply STOP at any time to stop receiving Messages. We will send one confirmation and then no further Messages unless you opt in again by replying START or reconnecting your number. You can also disconnect your number in account settings. After opting out, links you send by message will not be saved.

7. Privacy

We use your phone number and message content to identify your account, save the content you send, and reply to you, as described in our Privacy Policy. Messages are delivered through service providers such as Twilio and WhatsApp. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

8. Content you send

Only send content you have the right to share. Our Terms and Conditions, including acceptable use and copyright rules, apply to everything you send by message.

9. Carrier and delivery

Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and may be affected by factors outside our control. Supported carriers and availability may change.

10. Changes

We may update this policy and will post the new version with a new effective date.
